The use of this website by a user is considered acceptance of the terms of use and confirmation of compliance with them. The General Terms and Conditions may be updated at any time without prior and\/or express notice to the Users. The General Terms and Conditions are published on the website and everyone has access to them at any time. <\/span><span style=\"font-weight: 400;\">The website www.mymessytales.com and the associated online store at the same internet address are the property of the merchant.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For the purposes of these General Terms and Conditions, it is assumed that: www.mymessytales.com will be referred to as the website for short, My Messy Tales EOOD - merchant, each user of the website - user\/client, the selected goods\/services and all other attributes related to the method of delivery and payment of the goods\/service by the user\/client - order.<\/span><\/p>\n<h3>II. ORDER<\/h3>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Users of the website may place an order for any product\/service from the website only if it is in stock at the time of the order. Available products are those that have a stated price. The prices indicated on the website are in Bulgarian leva.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The merchant places an order for goods\/services to consumers via an online order form at www.mymessytales.com. By clicking the BUY button, the consumer agrees, fully accepts and undertakes to comply with these General Terms and Conditions.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The user can choose gift wrapping, free of charge, before finalizing the order. If the user does not check this option, then he will receive the order with basic, minimal packaging, the purpose of which is to protect the items from damaging their appearance and integrity. With minimal packaging, one leva from the amount of each purchased item should be donated by My Messy Tales to wildlife conservation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In order to identify and reproduce the user&#039;s statement of acceptance of these General Terms and Conditions, as well as the order placed, the following is done: storage in log files on the server of&nbsp;<\/span><span style=\"font-weight: 400;\"><a href=\"https:\/\/mymessytales.com\/en\/\" target=\"_blank\" rel=\"noopener\">www.mymessytales.com<\/a>, storage of the user&#039;s IP address, as well as any other information related to the implementation of the contract between the two parties.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After pressing the BUY button, the user agrees to purchase the goods\/services in the cart. This action has a legally binding force. The user receives a confirmation of the order to the e-mail address specified by him, and upon receipt of this confirmation, the contract is considered to be concluded.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The trader reserves the right to refuse delivery of a confirmed order in the event that the goods are not available. In the event of a lack of stock of the requested goods\/service, the trader notifies the consumer of the out-of-stock availability by sending a message to the e-mail address specified by the consumer or to the telephone number specified by him within 2 (two) business days of placing the order. In such a case, the trader may offer, and the customer may choose the following actions - cancellation of the order, replacement order or future delivery if the ordered goods\/service are available.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is possible that a representative of My Messy Tales Ltd. may contact the user at the e-mail address provided by him or by phone to clarify details of the user&#039;s order.<\/span><\/span><\/span><br><h3>III. DELIVERY<\/h3>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The delivery of the ordered goods\/services from the website is carried out by the courier company Econt, cash on delivery.&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A one-time order of goods\/services over 50 (fifty) leva is free of charge for Sofia and the country. Any delivery outside the territory of Bulgaria must be paid for at the relevant courier rates by the User, as well as any additional customs and other charges for the export.<\/span><\/li>\n<li style=\"\" aria-level=\"1\">The merchant undertakes to deliver the ordered goods within a period of at least 24 hours (on an official working day), but not more than 96 hours, with the exception of the personalized \u201cNight Adventures\u201d booklet. Personalization takes up to 10 (ten) working days, after which the specified delivery period follows. Official non-working days are not included in the specified periods.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For an order that needs to be received on a specific day or within a shorter period than specified in item 10, the user can note it in the Notes to the order field and My Messy Tales EOOD will contact him to clarify the possibility of this being implemented.<\/span><\/li>\n<li aria-level=\"1\">The consumer bears the entire risk of damage\/loss of the goods during delivery. Immediately after handing over the goods to the courier, the trader is released from the risk, which is transferred to the consumer.<span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> The merchant is not responsible for any delay in the event that the delay is due to a courier or other supplier.<\/span><\/span><\/span><br><h3 style=\"font-weight: 400;\">IV. RETURN AND EXCHANGE<\/h3>\n<p style=\"font-weight: 400;\">\n<\/p><\/li>\n<li aria-level=\"1\">Upon receipt of the shipment, the goods should be carefully inspected by the consumer or a person authorized by him. Any damage, bumps and other defects should be reported immediately to the merchant. <span style=\"font-weight: 400; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size );\">&nbsp;The consumer has the right to request a return and\/or replacement of the goods, provided that the damage was discovered in the presence of the courier and the customer called 089 895 2278 at the time of discovery of the damage.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">In cases where the trader has specified a specific date and time for delivery in writing, the statement has binding force. If an incorrect or incorrect address, contact person and\/or telephone number is specified when submitting the order, the trader is not bound by any obligation to fulfill the order.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Upon delivery of the goods, the consumer or a third party signs the accompanying documents. A third party is considered anyone who is not the holder of the application, but accepts the goods upon delivery and is at the address specified by the customer.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">In case of refusal to receive the goods, except in the cases described below, the refusal is considered unfounded and the customer is liable to pay the costs of delivery and return of the goods to the trader. In the event that the customer is not found within the delivery period at the specified address or access and conditions for delivery of the goods are not provided within this period, the trader is released from its obligation to deliver the goods requested for purchase.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">When the delivered goods clearly do not correspond to the goods requested for purchase by the customer, and this can be established through a simple inspection, the customer may request that the delivered goods be replaced with goods corresponding to the purchase application made by him within 24 hours of receiving it.<\/li>\n<li aria-level=\"1\">In case of non-conformity or damage, the customer may request a return or replacement of the product, <span style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size );\">within 7 calendar days<\/span><span style=\"font-weight: 400; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-size: var( --e-global-typography-text-font-size );\"> after delivery, if the product is a book or other publication with a defect or deficiency, expressed in missing pages, jumbled or missed copies. PRICES<\/h3>\n<p style=\"font-weight: 400;\">\n<\/p><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The prices indicated on the website include the price of each product, excluding delivery costs. The delivery cost is calculated by the courier company Econt and is formed based on the volume, weight of the shipment and the final delivery point. The user can find out the specific delivery cost of his purchase through the order form on the website, in the basket, where the goods selected by him are. The transport of the goods is carried out only within Bulgaria. In the event that the goods are sent outside the territory of the Republic of Bulgaria, the user\/client must pay all customs and other taxes and duties related to export.&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The merchant has the right to use discount vouchers, which are all promotional vouchers with a discount promo code that the user receives upon registration on the site or during various sales and marketing activities. Vouchers can be distributed online or in printed form, but are used only on the website.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vouchers are not purchased. RIGHTS AND OBLIGATIONS OF THE USER\/CLIENT<\/h3>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The user\/client has the opportunity to view and \/after filling in their data\/ order the advertised goods\/services on the online store www.mymessytales.com.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The user\/client has the right to be informed about the status of their order.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The user is obliged to pay the price of the order placed by him according to the method announced on the website www.mymessytales.com. Payment is made only after receipt of the goods, by cash on delivery, directly to the courier company Econt.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Every user, regardless of whether he is a client of the merchant, is obliged, when using the services, to immediately notify the merchant of any case of a committed or discovered violation when using the services provided.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The customer undertakes to provide an accurate and valid telephone number, delivery address and email address, to pay the price of the goods, to pay the delivery costs, when the same is not free, and to ensure access and the possibility of receiving the goods.<br><h3>VII. RIGHTS AND OBLIGATIONS OF THE MERCHANT<\/h3>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The merchant does not have the obligation and objective ability to control the way in which consumers use the services provided.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The Merchant has the right at any time, without notifying the User\/client, when the latter uses the services in violation of these terms and conditions, as well as at the discretion of the Merchant, to terminate, suspend or change the services provided in connection with the use of the website. The Merchant is not liable to users and third parties for any damages suffered and lost profits incurred as a result of the termination, suspension, change or limitation of the services, the deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used, recorded or made available through www.mymessytales.com.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The merchant undertakes to deliver the goods requested for purchase on time and to check each item for technical condition before it is shipped.<br><h3>VIII. PERSONAL DATA<\/h3>\n<p>May Messi Tales EOOD collects certain types of personal data in accordance with the General Data Protection Regulation (GDPR), which is in effect from 25.05.2018.<\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The merchant collects and may use the information of users, as well as those who have placed an order through the website www.mymessytales.com, solely for advertising purposes and direct marketing related solely to the merchant&#039;s activities.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The Merchant guarantees to its Users\/Clients the confidentiality of the information and personal data provided. The latter will not be used, provided or made known to third parties, except for certain data of the courier company, for the sole purpose of fulfilling the contract between the two parties.&nbsp;<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The data collected by the merchant upon ordering includes name and surname, current address, email address, telephone number, and of the above, the merchant reserves the right to use only the user&#039;s email address for the purposes of sending commercial communications from My Messy Tales Ltd.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The Merchant protects the personal data of the consumer\/client, which became known to him when filling out the electronic form for making a purchase application, and this obligation is waived in the event that the Client has provided false data. Subject to the applicable legislation and the clauses of these General Terms and Conditions, the Merchant may use the Client&#039;s personal data solely and exclusively for the purposes provided for in the contract. Any other purposes for which the data are used will be in accordance with Bulgarian legislation and applicable international acts.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The Merchant undertakes not to disclose any personal data about the Client to third parties - state authorities, commercial companies, individuals and others, except in cases where it has received the explicit written consent of the Client, the information is requested by state authorities or officials who, according to the current legislation, are authorized to request and collect such information. The Merchant is obliged to provide the information by virtue of the law.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">The user can unsubscribe from the newsletter of My Messy Tales Ltd. at any time through the corresponding link at the end of each newsletter.<br><h3>IX. AMENDMENTS AND SUPPLEMENTATIONS<\/h3>\n<p><\/p>\n<\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The General Terms and Conditions may be changed at any time by the trader, who has the right to change the characteristics of the goods\/services provided and these General Terms and Conditions and on the basis of changes in the legislation. The trader is obliged to notify the User of the changes to the General Terms and Conditions by publishing a notice of their changes in a prominent place on its website and giving the user sufficient time to familiarize themselves with them. Within the given period, if the User does not declare that he rejects the changes, then he is considered bound by them. In the event that the User declares within the given period that he does not agree with the changes, then the trader has the right to immediately suspend or terminate the provision of services to the User.\n<p><\/p>\n<h3>X.
